The 2023 Glastonbury Landowner's Association (GLA) Annual Election results have been modified by the GLA Board. Landowners were notified by email on Tuesday, November 28, 2023. The South Glastonbury results were changed to acknowledge that candidate Tim Brockett, who received 31% of ballots cast, earned a director's seat. And the GLA Board recognized Miriam Barker who received 6 votes as the new South Glastonbury Ombudsman. The GLA Board refused to treat all candidates equally; they are continuing to ignore the votes cast for 11 other candidates. Ten of those are in South Glastonbury and received one vote each. One is in North Glastonbury and received 3 votes. Director-Elect Tim Brockett addressed the unequal treatment of landowners and candidates with an email to the GLA Board.
Brockett wrote:
The 20 Vote Edict presented by Director Sedlak was illegal and thus invalid. All of the candidate's landowners voted for must be considered. The GLA Bylaws define how to deal with tie votes. The Forum will continue to follow this story as it unfolds.

To All:
I received an email that the GLA Annual Election results were modified to include me for a two-year term in South Glastonbury. I remind you that I earned that term by garnering a checked box on 31% of the ballots cast in South Glastonbury. Other candidates also received votes and earned a director's seat. I see that you have not yet recognized them.
The 2023 GLA Board violated our Bylaws and Montana State law by voting to approve the 20 Vote Edict. Election and Governing Doc Chair Director Andrea Sedlak presented the 20 Vote Edict as a "Procedure" to the GLA Board on September 14. As Chair of both committees, she had to understand that she was violating GLA Bylaws and Montana State Law. Director Sedlak was made aware of her legal transgressions by multiple landowners who spoke at the last meeting and submitted written comments. At that meeting, Sedlak failed to address how the 20 Vote Edict violated GLA Bylaws and State law. It appears from your email that the GLA Board still does not understand that and continues to hold themselves above the law. I remind you that you have no right to violate the law and all landowners must be treated equally before the law.
As such your "allowing" me to serve a two-year term on the 2024 GLA Board is not acceptable until you follow the law and treat ALL candidates equally. The landowners elected enough people to fill every board seat. Every candidate must be considered for a seat the landowners wanted them to fill. In the case of a tie vote, as we have in South Glastonbury, the Bylaws must be followed.
Olav Nordeman earned a director's seat in North Glastonbury with 3 votes. Those votes must be honored and Olav allowed to claim his seat.
In South Glastonbury, we have 10 candidates vying for two remaining open seats. All should be contacted ASAP, asked if they are willing to serve, and allowed an opportunity to withdraw if they wish. The remaining candidates can participate in a coin toss or a runoff election per our Bylaws.
Finally, the 2023 GLA Board must recognize their illegal actions and apologize in writing to landowners for not following the law. Director Andrea Sedlak should be censured and held accountable for her legal transgressions and unacceptable behavior. Failure to take responsibility and accept the laws that govern us has serious consequences.
Sincerely,
Director-Elect Tim Brockett
