Former Director Mark Seaver Sues the GLA - Seeks $59,000.00
On April 13, 2020 former Glastonbury Landowner's Association (GLA) Director and Treasurer Mark Seaver filed a complaint in Montana 6th Judicial District Court against the GLA. Seaver named current Board President Newman Brozovsky and Secretary Charlotte Mizzi in the lawsuit along with the Association. Mr. Seaver alleges that both President Brozovsky and Secretary Mizzi failed to perform their official duties and provide oversight for the Administrative Assistant, Karleen McSherry.
Despite Seaver's repeated requests to be removed from the GLA Board's private email and phone messaging system, landowner inquiries continued to inundate him. He diligently tried to respond and frequently asked the GLA to correct the problem. Over 20 emails were sent by Seaver to the GLA Board, pleading that the problem be corrected. More than 3 months passed before the annoyances were responsibly handled.
Former Director Seaver is asking the court for compensation of $11,800.00 for the continual work he did in reading and responding to 59 different emails. Additionally, he is requesting $47,200.00 in punitive damages.
Some may remember that the friction between Secretary Charlotte Mizzi and Treasurer Mark Seaver reached a boiling point at the November 2019 GLA Board monthly meeting. It was then that Seaver insisted that Mizzi's "accidental" withdrawal of $5,000.00 from the GLA savings account for her summer vacation to Malta was first brought to the attention of landowners. Shortly after publicly announcing the missing $5,000.00, Seaver resigned as GLA Treasurer and deposited the accounting computer and paperwork in front of Secretary Mizzi.
A paper copy of the lawsuit can be obtained from the Park County Clerk. It has blank pages that may be safely ignored. It may also be downloaded here.
