End The Board Deadlock by Separating North and South Glastonbury
One Board for Each Community and Legally Distinct

The idea is not new but the time may be right. On Friday March 5, 2021 Director Tim Brockett formally requested that the Glastonbury Landowner's Association (GLA) Governing Documents Committee research and report to the GLA Board what it would take to dissolve the current GLA Board into two legally separate boards; one for South Glastonbury and one for North Glastonbury. Each board could start with the current governing documents and then modify them as the landowners under their jurisdiction, North or South Glastonbury, wished. Brockett was immediately opposed by Director Mizzi who suddenly showed a renewed interest in having an election. Mizzi claimed "Before considering any changes to the Covenants we need an election starting from scratch". Claudette Dirkers corrected Mizzi by stating "Any changes to the Covenants is by vote of the entire membership, so new election does not have to precede changes to the governing documents. Mizzi replied "I beg you {sic} differ with you Claudette, We have a dysfunctional board and the issue of having an election comes first".

Brockett reasoned that two Boards would solve many longstanding problems and allow for greater landowner involvement. Each community has about 200 parcels so revenues would remain the same. The money could be more wisely spent and with greater landowner oversight.

Formal Request to The GLA Governing Documents Committee

The full text of Director Brockett's Formal Request follows:

I hereby formally request that the Gov Docs Committee research how the GLA can dissolve into two legally distinct Boards; one with jurisdiction over the parcels in North Glastonbury and the other with jurisdiction over the parcels in South Glastonbury as noted in the Covenant appendices.

Having two boards would immediately and forever solve the deadlock we currently have where four North Glastonbury members with the assistance of one South Glastonbury member have prevented ALL landowners from voting and benefitting from an election. A minority of one distinct half of the community, should never be allowed to dictate conditions for all of Glastonbury.

Separate Boards would better represent the interests of landowners and should be able to foster greater community involvement. In High South the consensus is almost unanimous for a South Glastonbury board. In Low South I believe a majority of people will vote for it.

Separate Boards could come about by landowner vote or by Court action. Landowner vote is preferable and I believe now is the time to have that discussion.

Gov Doc Committee - please schedule a meeting to discuss this idea and determine what actions are needed. Please involve landowners as much as possible once you have decided what changes must be made to our Governing Docs.

The following statement was presented to the GLA Board on March 6, 2021 by email from Director Brockett:

The deadlocked Board reveals the fatal flaw in our Governing Documents. Half of the landowners cannot vote for or against half of the Directors.

Four members from North Glastonbury, Directors Mizzi, Accatino, Newman Brozovsky and Gerald Dubiel have teamed up with one member from South Glastonbury, Ed Dobrowski. This cabal of five have denied all landowners the 2020 Annual Election, a fair hearing of petitions and regular monthly Board meetings. Every landowner in South Glastonbury is being denied participatory governance by four members that they did not vote for and can never vote out of office. A distinct minority has created a tyranny. Landowners have lost their democratic rights to self determination and a fully representative government.

It is as if Wyoming politicians were running Montana state government. Or landowners in Gallatin County were running Park County government. People who do not own land in the geographically and demographically distinct and separate community of South Glastonbury are denying South Glastonbury landowners the fruits of government. The same Cabal of Five from North Glastonbury do not have any problem with non-landowners serving as directors in a mutual benefit corporation designed to benefit just Glastonbury landowners.

Most revealing and galling is that the Cabal of Five wants to remove all members that oppose them in their quest for "harmony". It does not seem to matter that 4 or the 5 members they wish to depose were elected by Glastonbury landowners. The Cabal of Five also refuses to fill two empty Board positions as required by the Bylaws.

Dissolving the current GLA Board into two legally separate boards; one for North Glastonbury and one for South Glastonbury will restore rights of self determination and create a government that is both accountable to and fully representative of the people.
