Board Votes to Hire Attorney David Knobel A Director's meeting was convened on Friday night, June 25th to consider the GLA board response to the lawsuit filed by GLA President Newman Brozovsky and GLA Secretary Charlotte Mizzi against the Association. The GLA Legal Committee met a week previously and decided that an attorney was required to represent the board. They researched several attorneys and picked the one they thought was best suited for the task. At the Friday night GLA board meeting, Vice President John McAlister presented the Legal Committee's findings. Legal Committee member Claudette Dirkers made a motion that attorney David Knobel be hired at $295.00 per hour, with a $10,000.00 retainer, by the GLA Board to represent the Association in the pending Brozovsky/Mizzi lawsuit. Directors Accatino, Brockett, Dirkers, Ladewig, McAlister and Sedlak voted yes. Gerald Dubiel voted no. Director Mizzi and Brozovsky were present but had to recuse themselves because they were litigants. The motion passed with six yes votes and one no vote.
The meeting was cordial and respectful. The bitter infighting that characterized so many previous GLA board meetings was not present but there was tension in the air. Sedlak calmly asked both Dubiel and Accatino if they were comfortable with their votes. She explained that the motion was to hire a specific attorney to answer the Petition for Judicial Relief. Both replied that they understood the motion. Accatino hesitated but then voted yes. Dubiel voted no and then after Sedlak asked a few questions, he reaffirmed his no vote. Vice President John McAlister called the vote and stated that the motion passed. The meeting was then adjourned.
Two hours later Director Accatino sent an email to the GLA Board and attempted to rescind her yes vote. Accatino wrote:
Once a vote is tabulated and called it cannot be changed. So the six to one total stands and the Glastonbury Landowner's Association will be represented by David Knobel in their answer to the Brozovsky/Mizzi lawsuit.
