3rd Quarter Assessment Receipts Off By 60% or More
The Glastonbury Landowner's Association Treasurer, John McAlister, recently sent quarterly assessment bills to 163 landowners. Only 32 payments have been received to date. July 31 is the last day payments can be received without incurring late charges. While there may still be a last minute rush of payments it is widely believed that many landowners are withholding their checks as a protest against GLA dysfunction.
The 2020 Annual Election has yet to be held. Roads have not received any maintenance in 2021. Regular monthly board meetings have not been held since January. A resigned director was allowed to remain and vote which perpetuates the board deadlock. Motions to resolve the deadlock via mediation have all been voted down. A recent motion to fill board vacancies as required by the Bylaws was also voted down. An attempt to seek legal advice to determine the legality of allowing a resigned director to continue was also voted down. The long term past due collection process has been stalled for two years. Past due assessments are back over the $100,000.00 mark and rapidly approaching $150,000.00; more than the total 2021 GLA Annual Budget.

Meanwhile tens of thousands of landowner dollars are being spent on lawsuits. President Brozovsky and Secretary Mizzi are suing the Association. Directors Sedlak, Ladewig and McAlister have also filed a lawsuit against the Association. It is expected that up to $100,000.00 will be required to defend the Association against just these two lawsuits.
Landowners who choose not to pay their assessments will not receive a lawyer's demand of payment letter for at least two years. A future board may rule that the non-payments were a legitimate act of civil disobedience and thus may be forgiven. It is also possible that the GLA may not even exist in two years. The court will have the final say if the lawsuits run their full term.
