Court Mediator Named in Dissolution Lawsuit Tracy Axelberg is the court appointed mediator for the Sedlak Dissolution lawsuit against the GLA. A Mediation session will be held on October 4th, 2021. At that time the various attorneys, Axelberg, GLA Directors and other involved people will meet to decide whether they can agree to an out of court settlement. Our sources tell us that it is unlikely Mediation will come to a successful conclusion. Both sides are entrenched and appear unwilling to budge from their positions. We are told that the old timers in the community will refuse to accept even separation for North from South Glastonbury and are firmly opposed to dissolution. The dissolution crowd believes there is wide support in the community for at least separation.
The results of the mediation session will be presented to the court on October 9, 2021. If an agreement could not be reached, then a trial will be scheduled. There may be a public hearing before the trial. The court is backed up from Covid and a trial date is not expected for up to a year. Meanwhile all directors will remain in their positions and a new election is not on the schedule.
Old timers contend that a community wide vote will be needed for separation because it will require a Covenant change. The Dissolution side counters that a judge can easily override the Covenants via a court order. We will keep you posted as more court documents become available.
