Director Mizzi Perjures Herself... On March 30, 2022 Charlotte Mizzi filed a GLA Annual Report with the Montana Secretary of State that contained false information. Under penalty of law she supplied incorrect information on the form. The preface to the signature block on the form states:
Mizzi listed Newman Brozovsky as the GLA President and herself as the GLA Secretary. Both were removed from their corporate officer positions on August 23, 2022. You may read about the August 23, 2022 GLA Board meeting and download the draft Minutes here.
In an email to the GLA Board and Charlotte Mizzi on April 2nd, Director and Pro Tempe President John Mcalister states:
Previous to her filing of false information Mizzi created a phony 2022 budget without involving the Finance Committee. She also solicited a bid from Standish Excavation for spring and fall road work without full Road Committee input. The GLA Board did not authorize or even have knowledge of her actions until they were completed.
It is not clear what, if any, punitive action will be taken by the GLA Board to rein in renegade Director Mizzi. Director Brockett has filed a formal complaint with the Montana Secretary of State regarding the false information included on the GLA Annual Report. It will be up to the Secretary of State to decide upon what actions should be taken. Considering Mizzi's past history in removing $5,000.00 from a GLA bank account to spend on her Malta vacation, criminal prosecution may be a possibility. You may download the GLA Annual Report here.

Motion For Meeting Presented to the GLA Board On Monday April 4, 2022 Director Brockett presented a motion that woul require a GLA Board meeting within 7 days. Brockett wrote:
The motion need 6 yes votes to pass. The motion expires in 3 days.

Motion Still Open A day has passed since a motion was presented to require "The GLA holds a phone meeting within 7 days of this motion". No director has seconded the motion yet. President Pro Temp John McAlister has remained silent on this issue. Two days remain before the motion expires.
Meanwhile Gerald Dubiel presented a motion to approve a project on a parcel that has numerous covenant violations. Charlotte Mizzi seconded his motion.
The parcel in question has numerous structures that the GLA cannot locate Project Review records for. Apparently multiple buildings were constructed over a period of 20 years that were never reviewed by the GLA. A new owner wants to construct a guest house. John McAlister has argued that since the new owner did not create the violations he should not be responsible for them. Andrea Sedlak, Chair of the Governing Documents Committee, strongly agreed. Claudette Dirkers then quoted the Covenants. The Covenants clearly state that all violations run with the land. That is standard legal practice too. Four Directors, Dubiel, Mizzi, McAlister and Sedlak, appear to be in favor of violating the Covenants in the name of "fairness".
Director Tim Brockett opposed Gerald's Motion and suggested that the problem could be easily solved. He then presented a detailed solution and offered to be the mediator. He asked directors to vote according to the rule of law; not by how they feel or what they think is "fair". "The law should apply equally to all landowners" he stated. He again urged the Board to start conducting regular, monthly meetings.

Motion Still Pending ... GLA Website Active? The motion to have a GLA Board meeting within 7 days is still pending. No one has seconded the motion and thus no votes were cast. The motion expires in one day.
The motion to allow a landowner with multiple violations to proceed with constructing a new building has stalled at three votes. Project Review Chairman Gerald Dubiel presented the motion and Charlotte Mizzi seconded it. Tim Brockett voted no and asked that the motion be withdrawn until all of the property violations can be addressed and resolved. No other directors have voted for or against it.
The GLA Website is apparently back in business. Court documents revealed that website login credentials were given to Charlotte Mizzi several months ago. Yesterday she was asked by one director to immediately start posting Minutes and further update the long-neglected website. A few hours later Mizzi denied that she had access to the website.
A concerned landowner asked that the GLA better communicate with landowners via the website or a newsletter.
Information packets that should include Court orders are scheduled to be mailed to all landowners next week. Attorney Jackson is responsible for the mailing which was contracted to a Bozeman firm.

Both Motions Fail Due To Non-Voting Directors The Motion to hold a GLA Board meeting within 7 days has failed. Not one director bothered to second it or vote on the measure.
The Motion to allow a guest home on a parcel that has multiple covenant violations has also failed. Project Review Chair Gerald Dubiel proposed the motion. Fellow Project Review member Charlotte Mizzi immediately seconded it. President Pro Temp John McAlister and Governing Docs chair Andrea Sedlak voiced support for the motion but failed to vote on it. Jerry Ladewig and Tim Brockett voted no. All other directors did not bother to vote.

A Partial Victory On April 8, 2020 Melissa Lutgen, the Program Supervisor for the Montana Secretary of State emailed the Glastonbury Landowner's Association (GLA) Board to let them know that the invalid reports submitted by Director Mizzi were deleted from their records and website. Lutgen wrote:
Director Brockett filed a formal complaint with the Montana Secretary of State on April 3. He then encouraged other GLA Directors to do the same. Judging by Lutgen's response several followed his lead. As a result, the reports were removed and the way forward to an accurate report filing was provided. It remains to be seen if the GLA Board or the Secretary of States office will punish Mizzi for her transgression.
No new GLA Board meetings have been scheduled. The President Pro Temp is being pressured to schedule GLA Board meetings for the rest of the year. Vacancies need to be filled, roads must be taken care of, Projects reviewed and an Annual Election must be held. Normally planning for the Annual Election starts in May. Thus Director Dirkers and Brockett are asking that the next election, as ordered by the court, be scheduled for November.
Information packets are expected to be in the mail to landowners by the end of next week. The packets should contain court orders and pertinent information to bring landowners up to date regarding the Dissolution lawsuit and the way forward for the GLA.
