Director Mizzi asks for 2022 Election Investigation
Glastonbury Landowner's Association (GLA) Director Charlotte Mizzi sent an email to GLA Attorneys Nels Swandal, Ryan Jackson, and her personal attorney, Jennifer Reece on September 21, 2022. Mizzi asked that the Election results be put on hold. She states " We need transparency. We need discovery on who voted, who was not allowed to vote, and what allegations were made against Pouwel Gelderloos. Was there Due Process for Gelderloos?"
Mizzi added "The board meeting of August 19, 2022, where the board found Gelderloos in violation was a Zoom meeting and Gelderloos was muted and unable to defend himself. {Director} Andrea {Sedlak} who hosted the meeting had a conflict of interest in voting, she was running for the board along with her husband Mark Seaver."
The Forum found that almost all landowners and many board members were muted at the August Board meeting. Lines were briefly unmuted when directors voted and then made silent again. Several directors and landowners complained via email to the GLA after the meeting but no action was taken. Since any participant can mute any other participant on the Dialpad system the GLA uses, no one person could be found responsible for all of the muting.
Mizzi included a September 21 email from disqualified GLA candidate Pouwel Gelderloos who asked:
"1) Why are the vote counting results not sent to all members?
2) Why has Judge Gilbert not ratified the election?
3) Why was the Pouwel Gelderloos candidacy removed (without anyone being notified?)
If there is any time to DEMAND transparency it would be this week before a "transfer of responsibilities" meeting will take place on the 27th at Chico.
4) How is this meeting even possible without ratification of the election??"
A GLA Board Meeting has been scheduled for Tuesday, September 27, 2022. At that meeting new directors are to be seated, officers elected and committees formed. Mizzi's request to have the meeting postponed is not yet a legal request. However, Director Mizzi could file a motion asking for an emergency stay with the 6th District Court. If granted, the motion would "stay" or freeze the election process until the court revisited it.

The court may also consider whether Neil Kremer was a valid candidate. Park County has confirmed that he has three houses on one parcel. The Covenants and Master Plan only allow two houses per parcel.
Why did the current GLA schedule a "transfer of power" meeting before Judge Gilbert renders her ruling? Director Brockett posed that question to the GLA Board. President John McAlister responded by saying that Attorney Swandal authorized the meeting. If the GLA separates then new officers will need to be elected and committees formed for GLA-North and GLA-South.
Director Mizzi could boycott the September 27th meeting as she and her allies have done in the past. Traditionally outgoing directors do not show up for the seating of new directors unless they were reelected. Could new directors be seated if they boycotted the meeting? That has never happened.
The Forum and Director Tim Brockett have asked for Election transparency for years. It would be a welcome service to landowners if all 2022 Election documents were released and publicly verified. The 2022 Election produced a tie vote and one candidate lost by just one vote. A recount with 100% transparency would serve landowners well and should put to rest any lingering doubts.
