Declare your independence. Legally stop paying assessments to an inept GLA Board
Many landowners are dissatisfied with the GLA Board and how it manages their money. Almost one out of three or 29% have stopped paying their assessments as of February 29th, 2016. Others have thought about divorcing themselves from the community by selling their property and moving away.
We all agreed to abide by the Covenants when we purchased property and moved to Glastonbury. The Covenants require that we pay assessments to the GLA Board and again, per the Covenants, they are responsible to manage our money wisely. So what legal recourse does a landowner have when they believe that the GLA Board is NOT managing their money well? Can a landowner simply withhold their assessments as an act of civil disobedience? As noted above 29% of the landowners are no longer paying assessments.
There is a better way.
While studying the Covenants we found a better way to declare your independence from an inept GLA Board, eliminate assessments and even increase your property value. You might even qualify for a refund on assessments paid.
Covenant 1.04 allows any landowner to withdraw their property from the Covenants by simply submitting a written request to the GLA Board. By a simple majority vote, the Board can agree to your request, and remove your property from the assessment rolls. If they vote no, then a written request from your attorney for another vote will most likely change their minds.
Below are Covenants 1.03 and 1.04 from the Glastonbury current Covenants.

Once your property is removed from the GLA assessment list you will no longer have to pay yearly dues. Since we prepay our yearly assessments in January you may be eligible for a refund. The GLA Covenants and Master Plan would no longer apply to your property so you could build what ever you wanted to as long as you comply with County rules. Unencumbered by GLA assessments and strict rules the value of your property should immediately increase. There are very few properties in Paradise Valley that are not part of an Home or Land Owners Association.
You will now have the same rights granted to the Church Universal and Triumphant and private individuals who own hundreds of acres of land abutting Glastonbury roads but are not required to pay assessments nor abide by the Covenants or Master Plan.
You will lose the right to vote and you could not serve on the GLA Board.
Rights of way remain the same but you will not have to pay for road maintenance or plowing. You always have the option of being a good neighbor and donating money to, and assist in creating, a Road Maintenance Organization that is 100% independent of the GLA Board.
If at some point in the future you wanted to rejoin the GLA, Covenant 1.03 states that you could write a simple request and submit it for a Board vote.

In another post yet to be written we will discuss how the Community of Glastonbury can move forward, hand in hand, while respecting the rights of all as enshrined in our Constitution. Declaring your independence from the GLA Board does not mean that you are no longer a citizen of Glastonbury. It means that you reject the old ways of thinking and mistreatment of landowners while embracing a vision of neighborliness or brotherhood that will lead us to a brighter future.
