Finance Committee 2016 Member Confidentiality Agreement
The Finance Committee requires most members and volunteers to sign a Confidentiality Agreement. A notable exception is landowner and financial expert, Regina Wunsch who is also the unofficial GLA Treasurer. She refused to sign an agreement and was still allowed access to Quickbooks and many financial records.
Volunteers have offered their assistance to the Finance Committee but several were turned down after they refused to sign the Confidentiality Agreement. At least two volunteers the Forum knows of were not church members and it is not clear if that was a reason they were held to a different standard than Regina Wunsch.
The Confidentiality Agreement is a vague and troublesome legal document. It requires that the recipient sign away their Constitutional 1st amendment right to freedom of speech. The signer agrees never to dicuss any information that "could reasonably be expected to adversely affect the GLA’s operations or the privacy of individual Glastonbury Landowners".
All fair minded people agree that releasing landowner social security numbers is not appropriate. It may even be illegal. The agreement covers far more information than just social security numbers and there is no expiration date. Signers agree to never, ever disclose any information that could harm the GLA in any way. Thus if a signer witnesses fraud, theft or other illegal activities they must keep quiet or face the possibility of a lawsuit from the GLA Board. To date the Confidentiality Agreement has had a chilling effect in recruiting volunteers to assist with GLA Board duties.
All directors are required by the current GLA Board to sign a similar agreement. However, neither Montana State law or our governing documents make signing mandatory. Signing away your 1st Amendment right to freedom of speech is strictly voluntary. It will be revealing to see if any newly elected GLA Board members will agree to sign away their constitutional right.
