O'Connells are Declared Vexatious Litigants Valery and Dan O'Connell and their 3 children, Christal, Shannon and Vesta were officially declared "Vexatious Litigants" by the Montana Sixth District Judicial court. In a detailed and informative ruling the court listed every case the O'Connell's filed since 2008. The court looked for patterns of behavior and determined that "that the O'Connells simply have no respect for the judicial system".
What does this mean for the O'Connells and the Glastonbury Landowners Association?
The GLA cannot be easily sued by the O'Connells any longer. Before filing any legal briefs the O'Connells must receive permission from a judge to proceed. That will be difficult to acquire.
The GLA will also be able to submit a request for recovery of attorney's fees and cost by April 1st. The court will then issue a judgement against the O'Connells or if the O'Connells protest, the court will set a hearing date. The O'Connells may receive a large bill for all their efforts. Since an insurance company paid for the GLA litigation it is unlikely that the GLA would receive much, if any money for their trouble.
We will keep you posted.
Meanwhile you may download and read the Court ruling here. It is easy to understand and an interesting read.
