GLA Board is being Sued for "Irreparable Harm" to Kathleen Rakela
The Latest on the Case
(January 27, 2018) The Forum has learned that both Kathleen Rakela and the GLA Board attorneys agree it does not look like a settlement can be reached. We can confirm that Rakela's attorney will soon request a hearing on the TRO (delay of election). Her lawyer will also ask the court to schedule a conference on the civil action (the irreparable harm caused to Rakela by the GLA Board). Thus the two issues will be soon separated by the court.
The TRO hearing has not been scheduled yet but we expect it to show up on the court calendar in 30 to 90 days. The Forum expects another 30 to 90 days for a court decision if things go smoothly. After the TRO is resolved the GLA will need a minimum of 45 days to get ballots out and schedule another election.The 2017 annual election could be held as early as late May to mid-July depending upon how quickly the TRO is resolved. The lawsuit regarding "Irreparable Harm" would continue at least until October 2018 and most likely well into 2019.
A Coup d'état in Slow Motion?
The Rakela lawsuit and TRO lead to many unanswered questions. Who is financing her legal actions? What exactly is the "irreparable harm" Kathleen Rakela suffered at the hands of the GLA Board? What will it take to heal that harm? What will happen to the lawsuit if a new election is scheduled and the CUT candidates are defeated? What happens if they all win? Time will provide answers for questions and we will post more as we learn more.
